Police in San Bernardino County are dedicated to spotting drivers who are under the influence of drugs or alcohol. In 2011, there were 11,977 DUI arrests in San Bernardino County. This was an almost 8% reduction from the previous year. The largest percentage of people arrested were males in their 20s.
The San Bernardino County Sheriff's Department is part of 25 law enforcement agencies that work together to form a DUI enforcement team known as “Avoid the 25”. San Bernardino County DUI Charges
First DUI: Even a first time DUI offense can result in steep sentencing. The maximum penalties for a first DUI are 6 months of jail time and $1,000 in fees. In addition, you can be sentenced to probation, community service, DUI classes, substance abuse treatment, license suspension and more. In 2010, 70.6% of first time DUI offenders were sentenced to some jail time. Judges do sentence first time offenders to the maximum penalties especially when high BACs or accidents were involved.
Repeat DUI: If you have been previously convicted of a DUI and are arrest again, you will face even steeper consequences. California law requires every DUI conviction from the past 10 years to be considered when sentencing a DUI charge. For every conviction that you have in that time period, you will receive greater maximum penalties. In 2010, most repeat offenders in San Bernardino County received jail time, probation and 18 months of DUI education. A second or third DUI can result in higher fines and more jail time as well as license suspension.
Felony DUI: Most DUI charges are misdemeanors, but some very serious situations can result in felony DUI charges. In 2011, 2.9% of DUI arrests in the county were for felony DUI. Once you are charged with felony DUI, all subsequent DUI offenses will also be charged as felonies even if you are only slightly over the legal BAC limit.
Underage DUI: Minors under the age of 21 face a zero tolerance policy when it comes to drinking and driving in San Bernardino County. Anyone under the legal drinking age found driving with any amount of alcohol in their system will face DUI charges that can lead to license suspension and more. In 2011, 58 juveniles were arrested for DUI with a BAC over .08% in the county and faced under age DUI and DUI charges.
Drug Related DUI: Just like alcohol, you can be charged with driving while intoxicated by drugs. The penalties for drug DUI are the same as alcohol but you can also face drug possession charges if illegal drugs or a controlled substance are found in your vehicle. Drug DUIs are treated very seriously. In 2010, 14.3% of all serious DUI accidents in the county were the result of drugged DUI.
DUI Accident: After an accident, police will often check the BAC of all drivers to make sure no one was intoxicated. If you are found to have .08% or higher BAC, you may be charged with causing the accident. This is a serious offense that D.A.'s look to prosecute.
