DUI Statistics in Orange County
In Orange County, a person can be charged with Driving Under the Influence or DUI for opening a vehicle with a blood alcohol concentration (BAC) of .08, under the influence of drugs or while impaired by either. According to the California DMV's most recent report, in 2011, there were over 16,000 DUI arrests in Orange County alone. This was a .2% increase from the year earlier and about 9% of the total number of arrests in the State. Of these, 1.6% were felony charges but the majority were misdemeanor offenses.
DUI Penalties in Orange County
Most first time offenders are sentenced to probation, completion of a first time offender DUI program and a fine. Almost all repeat offenders in 2010 were sentenced to some jail time and an 18 month DUI education program. About 6% of all offenders were sentenced to the installation of an ignition interlock device (IID). To make matters even more serious, Orange County has a very high DUI conviction rate; in 2010 83.8% of DUI offenders were convicted.

This does not mean that they will get off easy. Judges look to discourage repeat offenders and will not hesitate to give first time offenders the harshest sentences in order to ‘scare them straight'.
Repeat DUI: If you have a prior DUI conviction in the past ten years and get stopped by police for driving under the influence a second time, you will face charges for a second DUI. In 2010, about 25% of all DUI arrests in the County were repeat offenders. The legal process is still the same, but the penalties including jail time, fines and license suspension all increase.
Under 21 DUI: For minors under the legal drinking age, you can be charged with underage drinking and driving for have any amount of alcohol in your body. If you are under 21 and have a BAC of over .08%, you will face DUI consequences and those for underage drinking. In 2011 .6% of DUI charges in Orange County were for juvenile offenses. In addition, under Orange County Minor in Possession laws, you can lose your license for having alcohol whether you were driving or not.
Drug Related DUI: DUI charges can arise from drugs as well as alcohol. Drugs impairment is harder to measure and the evaluation system is not as streamlined for drugs as it is for alcohol DUI. Still, it is important to remember that a police officer can arrest you if they suspect that you are driving under the influence of illegal, prescription or even over-the-counter drugs. In 2010, about 14% of serious DUI accidents by first time offenders in Orange county involved drug intoxication.
BUI: Just like cars, boats cannot be operated by a driver who has been drinking. Boating Under the influence, or BUI, can have harsh penalties. Commercial DUI: If you have a commercial driver's license, it is important that you know that commercial drivers have a lower BAC limit (.04%) and a commercial DUI arrest will lead to license suspension and more.
DUI Accidents: DUI charges are made much worse when an accident is involved. In 2010 379 serious DUI accidents were caused by first time DUI offenders in the county. If you cause serious damage or injury or if someone is killed in an accident where you were driving drunk, you will be charged for driving under the influence and causing an accident. These offenses are often charged as felonies and can lead to 40 years in prison.
