DUI Charges in Irvine, CA

According to recent statistics, Irvine has a very low crime rate. In fact, in 2010 the city had the lowest violent crime rate among U.S. cities with populations of more than 100,000. One type of crime that is immune to criminal statistics is DUI. Anyone can be arrested for DUI at any time. The Irvine police website states that in 2012 there were zero DUI related fatalities but there were 30 DUI related injuries.

Police in Irvine routinely perform sobriety checkpoints and DUI patrol during nights, weekends, and other times when DUI drivers are more likely to be on the road. In November 2013, for example, the city received a grant of $77,050 for sobriety checkpoints from the California Office of Traffic Safety (OTS). They also received a grant of $111,956 to set up a yearlong DUI education program aimed at increasing awareness and safety in the city. The program, called The Selective Traffic Enforcement Program, will include the following activities:

  • Special training for police officers so that they can better evaluate impaired drivers
  • Increased DUI patrol officers
  • Enforcement of motorcycle safety
  • Targeting DUI offenders with Warrant service operations

Irvine DUI Penalties

When you are stopped by police in Irvine and they suspect DUI, you will be asked to take sobriety tests. If you are asked to take a field sobriety test, you can freely decline. These tests are voluntary and can be declined without penalty. Some chemical sobriety tests measure the amount of alcohol in you system by taking a blood or breath sample. These tests can be declined, but with penalty. When you accept a driver's license form the DMV you are also giving your Implied Consent to submit to a blood or breath test when asked by law enforcement. If you decline these tests, you will lose your license for a year or more depending on the number of refusals you have had in the past. You can also be subject to steeper sentencing if you are convicted for the DUI. A DUI conviction can result in serious penalties. For example, the sentences in Irvine for a violation of 23152 VC include:

  • First Offense:
    • A fine of $390 - $1,000
    • License suspension of up to 6 months
    • Up to three years of informal probation
    • First time offender DUI education
    • 96 hours to 6 months of jail time
  • Second Offense:
    • A fine of $390 - $1,000
    • License suspension of up to 2 years
    • Up to three years of informal probation
    • 18 months to 30 months of DUI education
    • 90 days to 1 year of jail time
  • Third Offense:
    • A fine of $390 - $1,000
    • License revocation
    • Up to three years of informal probation
    • 18 months to 30 months of DUI
    • 120 days to 1 year of jail time

In addition, a DUI on your record can hurt your chances at acceptance to some jobs and schools. Police officers are sometimes over eager to make DUI arrests.
